Personal Information That You Provide To Us. Specifically, we collect following information:
- Marketing Communications: If you sign up to receive our marketing emails or we otherwise have your consent, we will collect and use your email address to send you emails about available units, news, and other updates. Likewise, submitting a contact form may result in follow up correspondence from a Torque representative. If you no longer wish to receive these communications, you can unsubscribe at any time by clicking the “unsubscribe” link included at the bottom of any marketing email. Alternatively, you can opt out of receiving our marketing emails by contacting us at the contact information under “Contact Us” below. Please note that you may continue to receive certain transactional or account-related communications from us. We may also use services provided by third-party platforms to serve tailored advertisements on those platforms, and we may provide a hashed version of your email address or other information to the platform provider for such purposes. From time to time, we may ask you to confirm or update your marketing preferences if you instruct us to provide further products and/or services in the future, or if there are changes in the law, regulation, or the structure of our business. - Employment: When you apply for a job with Torque, we may collect your name, address, email address, phone number, resume, work history, education history, and any additional information required for the application process.
- Torque Reviews: If you submit a review to us to be included on the Site, we may collect your name, address, email address, photograph, video, phone number, and any additional information you choose to provide in relation to your review.
- Identity Verification Information: In certain contexts we may be required to verify your identity by collecting information such as your social security number, driver’s license number, state or federal identification number, and similar identifiers.
- Commercial Transaction Information: We maintain records of commercial information related to our services, including records of property obtained, products, or services obtained or considered from Torque or others, as well as your purchasing or consuming history and tendencies.
- Financial Information: When we facilitate financial transactions or use one of our subsidiaries to facilitate the financial transaction, we may collect personal information related to such services, which may include information about your credit, personal finances, real estate and rental history, and similar information. Additional information about Torque’s privacy practices with respect to financial information will be provided in the appropriate manner based on the nature of the services.
- Personal Characteristics: Using the information we gather about you, we may infer characteristics about you pertaining to your personal preferences (such as your taste in condominiums or vehicles), your characteristics (such as your buying power) and your behavior. We maintain this information to provide more tailored services to you and to present you with content, communications, and choices that are relevant to you.
- Records of In-Person / Telephonic Interactions: We may collect personal information about your in-person interactions with our services and facilities. For instance, if you visit one of our physical locations (such as a Torque model unit, property, or office), we may collect audio or video footage taken at or near the location (and collected consistent with local law). If you interact with us on the Site, over the phone, via mail, or email, we will collect and maintain records of your interactions, including through telephone records, voicemails, emails, chat histories, and messaging histories.
We may also collect your information if you contact us for customer service purposes:
- Customer Service: When you contact us with a comment, question, or complaint or complete our customer service form online, you may be asked for information that identifies you, such as your name, email address, mailing address, and a telephone number, along with additional information we need to help us promptly answer your question or respond to your questions or comments. We may retain this information, including records and copies of your correspondence, to assist you in the future and to improve our customer service and service offerings.
We may also use automatic data collection technologies to collect certain information:
- Personal Information Automatically Collected: We use cookies and other technologies to collect personal information automatically through your use of the Site as described in the section entitled Information Automatically Collected.
We collect information via the Site that you voluntarily provide to us, for example, by completing online forms or e-mailing us, as discussed above in Collection and Use of Personal Information. In addition, we use various web tools such as cookies, web beacons, and other technology that are sent to and stored on your hard drive. These tools will automatically collect and log web usage data from you when you visit the Site.

We only allow our service providers to handle your personal information if we are satisfied that they take appropriate measures to protect your personal information. We impose contractual obligations on service providers, contractors, and third parties to ensure that they can only use your personal information to provide services to us and you.
We may aggregate your personal information and disclose such aggregated information to advertisers for other marketing and promotional purposes. However, we will not disclose to these entities any information that could be used to personally identify you.

We will not accept Shine the Light requests by telephone or by fax and are not responsible for requests not labeled or sent properly, or that are incomplete.

Right to Confirm | You have the right to confirm whether or not we are processing your personal information. If you or an authorized representative want to review, access, correct, or withdraw consent to the use of your personal information you may send us an email at info@torqusuites.com to request access to, correct, or delete any personal information that you have provided to us. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect. We may request specific information from you to help us confirm your identity and your right to access, and to provide you with the personal information that we hold about you or make your requested changes. Any personal information we collect from you to verify your identity in connection with your request will be used solely for the purposes of verification. To verify a request, you will need to provide:
- Enough information to identify you;
- Proof of your identity and address;
- A description of what right you want to exercise and the information to which your request relates; and
- If your request is submitted on your behalf by an authorized representative, you will need to provide proof of the representative’s authority to act on your behalf by writing signed by you.
If we are unable to verify your request, we may deny the request or ask you for additional information that is reasonably necessary to authenticate your identity in connection with the consumer request.
Once submitted, you will receive an email within 10 days that we will use to verify your identity and provide confirmation of your request. We will respond to your request to know or delete or correct within 45 days from the day we receive the request. If necessary, we may extend the time period to a maximum of 45 additional days from the day we receive the request. In such case, you will receive an email notifying you of the extension and explaining the reason for the extension.
Applicable law may allow or require us to refuse to provide you with access to some or all of the personal information that we hold about you, or we may have destroyed, erased, or made your personal information anonymous in accordance with our record retention obligations and practices. If we cannot provide you with access to your personal information, we will inform you of the reasons why, subject to any legal or regulatory restrictions.
You may also have the right to appeal our decision if we deny your consumer request. If we deny your consumer request, you can send an email to info@torquesuites.com requesting an appeal of the denial. Within 45 days of receipt of your appeal, we will inform you of the action we took or did not take in response to your appeal. We may extend the 45-day period by an additional 15 days where reasonably necessary and inform you of the delay and the reasons for the delay. If your appeal is denied, we will provide you with an online mechanism to contact the Attorney General to submit a complaint in your respective state.

We will keep your personal information for as long as necessary to fulfill the purposes we collected it for and in accordance with our internal document retention policy and any applicable laws. We will retain and use your personal information as long as you have an account with us or we are providing products and/or services to you. Thereafter, we will keep your personal information for as long as is necessary:
- To respond to any questions, complaints or claims made by you or on your behalf;
- To show that we treated you fairly; or
- To keep records required by law.
We will not retain your personal information for longer than necessary for the purposes set out in this Privacy Notice. Different retention periods apply for different types of personal information.
Under some circumstances, we may anonymize your personal information so that it can no longer be associated with you. We reserve the right to use such anonymous and de-identified data for any legitimate business purpose without further notice to you or your consent.
The Site is intended for use within the United States, and is not intended to be used in any other territory. The Site may function in countries other the United States. If you use the Site from outside the United States, you explicitly accept that your personal information may be transferred to, stored, and processed in the United States where laws regarding processing of personal information may differ from the laws of other countries.
To protect your personal information in our custody or control from theft, unauthorized access, use, modification and disclosure, and to maintain its accuracy and integrity, we have implemented reasonable technical, physical and administrative security measures. These measures include:
- Stored on secure servers behind firewalls; and
- Other measures to secure the personal information from accidental loss and from unauthorized access, use, alteration, and disclosures.
Although we have implemented reasonable safeguards, please note that no electronic transmission of information can be guaranteed to be entirely secure.
